Can you leave Chile during citizenship process?

Post by fadgaget » Sat Aug 31, 2019 10:09 am

Hi all,

I keep seeing on here multiple folks saying they've been waiting 1-2 years+ after submitting app, doing interview and paying fee.

Is it really true that you can't leave Chile until you have your naturalization certificate and Chilean passport in hand? Meaning, we really can't leave at all til the process is formally done????

Feeling sequestered and I haven't even started the process yet!

- Permanant resident since 2012
- Been renewing prorrogas while in U.S. since 2013 with only one month long visit to Chile to be able to reset properly time so I'm currently up to date and have prorroga too Nov 2019
- Married for 7 yrs to Chilean
- We live in U.S. but will be retiring in Chile
- Really getting tired of prorroga process every year
- Have jobs in U.S. which is why we haven't been able to get back to Chile
- Our entire family is in Chile
- We have bank accounts that we use regularly and investments in Chile, etc.

Thoughts???

Hi admin!

Yes you can leave Chile while waiting? or yes you cannot leave while you wait because it can cause issues with your citizenship application after submission?

Please clarify. Thanks!!

yes, you can leave.

if you leave however, for years, without demonstrating a significant connection to the country they can reject your application for citizenship. the rule they have been applying is 180 days in the country per year.

a lot of people, about 10 years ago, were obtaining perment residency in chile, then leaving, and never even visiting chile. essentialy passport shoppers. they were thinking that would be sufficient to qualify them for citizenship. the department of immigration put a stop to that a few years back.

the 180 day rule however is not a hard and fast rule. other things are considered.

Hi again, Admin!

Thank you for taking the time to clarify. Obviously due to our jobs here in the US, staying in Chile at this moment in time is not an option. Just out of curiosity though, if you're eventually rejected for citizenship due to the 180 day requirement, (provided that all other documentation and requirements ARE in order), do you loose your permanent residency??? or do they take it ALL away and you literally start from square 1?

Thank you kindly for your time!

Good to know that so long as you record is clean and you have stayed within the requirements to maintain the permanent residency that at the very least you won't lose your permanent residency if you are denied citizenship, *phew!*

Thank you SO much Admin! So grateful for your guidance on this one!!
