U.S. Marriage divorce, now time for Chile

Significant other and their ex-spouse both reside in the U.S. Their marriage is dissolved up here, but back home, Chilean government still recognizes it. My S.O.'s chilean lawyer is trying to get ex spouse to give them power of attorney so that they both don't go to Chile to deal with it, only my s.o.

Does this have to be done at the chilean consulate in san fran(we are in wa state) or can any U.S. notary be good? Does that then need to be sent to the consulate to also be notarized by a chilean official? Someone here has had to been through this before.

why is the attorney not handling this?

they should be providing the precise instructions required for that document and if they are not it is a serious sign they have no idea what they are doing.

The attorney said that it just needs to be notarized, but my s.o. is unclear if a u.s. notary will suffice for the bureaucracy in Chile.

With all due respect, you need a lawyer that's experienced in dealing with this kind of situation. Divorce is serious business, and a lawyer worth your money should be able to at least know how to proceed without you needing to research it by yourself.

Yes, you might be able to get anedoctes about how it's done, but is it really worth it? Don't get legal advice from non-lawyers.

This forum's Admin runs a reputable legal company in Chile. It might be worth using his services, specially if your lawyer don't know how to proceed.

Their contacts are at that page. Your lawyer having no idea where you need to notarize your documents = no bueno. Red flags all around. Get yourself good legal advice. Follow said legal advice. Don't try to get advice from complete strangers on your divorce proceedings. Don't put your estate on the line of a (potentially vengeful/greedy) ex-spouse, especially if said estate includes a single peso in Chile. Get good legal counsel who has handled this kind of potentially complex legal case before.

here is the problem. there are a million variables related to any particulare international divorce. We could not even begin to answer how that document should be handled, without examing the full details of the case. It is not like say selling a car.

but, it is for that exact reason your attorney should be on top of it to insure it is handled correctly.

For an attorney to only say vaguely "it just needs to be notarized", indicates to me the attorney is learning a lesson in the 101 of handling international divorces, powers of sttorney, etc at your expense.

what else are they taking for granted in handling the divorce with foriegners involved?
