SANTIAGO.- Un histórico fallo captó la atención en Concepción en donde una madre ganó una demanda contra sus hijos por una millonaria herencia de alrededor de 10 mil millones de pesos.
Según lo reportado por El Sur de Concepción, la mujer convivió con su pareja pero nunca se casaron, por lo que sus tres hijos eran sus únicos herederos. Luego de la muerte del hombre, su conviviente no recibió ninguno de sus bienes, lo que la llevó a demandar a sus hijos.

In a nutshell, the Judge admitted the principle of concubinage and ruled that an inheritance be divided up between a mother and her three sons. But the mother had to take her sons to court; they would have left her with ni uno otherwise. Prior to this judgment an unmarried woman had no rights of inheritance when her de facto husband died.

Considering the value of the estate was Ten Thousand Million Pesos, the sons' (not uncommon) behaviour towards their mother can only be put down as usual, to plain greed and selfishness.

The concept of a Common Law wife didn't exist here before this historic ruling, but now these spouses may possibly be legally defined as "Concubines", maybe a they'll invent a less biblical term.....

My prediction: Chile SJWs will go apeshit over that term in the new year.

Interesting and important info though as imagine all the unmarried parejas with kids in Chile...

Trouble is that the Chilean legal system doesn't take much notice of precedent till it becomes written law. That could take years.....the Judge was following guidelines handed down by the Supreme Court.

interesting, but that case has a few rounds to the supreme court to go.

i would not be suprised to see someone in congress introduce a law to explicitly block the women from getting anything.

funny just the other night at dinner with some friends, we were talking about DNA, sites like 23andme, etc.

we all had a good laugh about what happens to the inheritance laws when DNA testing prices come down, and more and more chileans start self-testing. when all those illegitimate kids start figuring out what they are realy entitled to now.

I seen a stat recently, given the small size of chile, you only need about 1700 people to be dna tested to figure out how almost all the rest are related.

Yep, down here in Auracania I can see Mapuche in the genes of a great swag of people who are either ignorant of their ancestral heritage or would never admit it. Morbid obesity is the big hint, their predominate native genes are unsuited to the modern cheap diet of high carbs and sugar. You see it all over the world among native peoples and their descendants.

i always chuckle at the rampent racism in latin america.

i went to school on an indian reservation in the u.s., worked and lived with various native american tribes. there are tribes in the states where a 1% "blood quantum" was sufficient to get you a BIA number and some casino money. people you could not detect a single typical native american physical feature in them were super proud of their heritage. i had indian friends with red hair and blue eyes. most north american tribes in the states these days, anyone with 1/3 or more indian ancestory is considered a "full" indian, anyone with 2/3 or more is a super big deal and pretty rare occurrence.

in latin america, you run in to people all the time that swear up down they are european and as white as the driven snow, but have some of the most obvious indian genetic features i have ever seen. the nose, cheekbones, eyes, height, ears, etc. the biggest tell, is the bad reaction to alcohol. hell, most of the population of latin america that claims to be white, was probably born with the "mongolian spot".

In fairness to the indian tribes of the americas, there is more to being Indian than who your ancestors slept with. It is a cultural thing, more than a genetic thing. Culture can drive genetics, and genetics can drive culture.
