Re: John Cobin in the news
So, it seems that he's being formally charged with four crimes. I wonder what comes next now, as I'm really not familiar with Chilean criminal proceedings.

Re: John Cobin in the news
Let's see.
He is stuck in jail, waiting for trial, with the courts backed up or closed for who knows how long, during a pandemic of a disease that targets his age group, with exactly the kind of people he tried to kill (I am sure a vast amount of other inmates would like to get to know him).
The possibility of being convicted of attempted murder might be the least of his problems.
He sure showed those protesters. Bet they learned their lesson good. They will never do that again.

Re: John Cobin in the news
seema cobin tested positive for covid, then tried to ask for a release based on his health risk profile. court denied it.

then it seems it was appealed and denied
looks like he is set for trial to start end of September, but that will probably be delayed. The entire court system is backed-up.
just in to time for the next social crisis.

The trial date is set for Sept 28th on John Cobin. I wonder if he will get time served for the last 10 months

The trial starts at 11:00 a.m. today.
As far as time served, does not matter. They are asking 17 years. At his age, probably a life sentence.

Re: John Cobin in the news
17 years
17 years seems excessive, maybe he will be out in 3 or 4? When a double murderer in Chile can get let out after a few years by a judge and go on to murder and mutilate a teenage girl? Why can't John expect same leniency in a few years, if he's found guilty I guess.

Well, big difference between asking for it, and the sentences handed down. Then appeals, etc. The final sentence, could be years away.41southchile wrote: ↑Mon Sep 28, 2020 11:41 am17 years? Seriously WTF. I would of thought 5 or 6 tops.

There has also been a rather tectonic shift in the trends of sentencing by judges and prosecutors over the last year.
Judges were personally spooked by the 18-0 security situation.
Judges got a shot across the bow with the recent move to impeach and remove judges that were too soft on sentencing.
Prosecutors and government have been getting sued by victims and their families for mishandling cases, and they have been winning big time. Like hundreds of thousands of dollars per case.
That is all aside from shear optics in the middle of the social crisis, of a right wing government looking like they are showing favortism to a right wing extremists gringo shooting in to a crowd in broad daylight after making political statements. Think CIA / coupe / human rights abuses history. Kind of surprised they did not charge him with terrorism related charges.
So yea, throwing the book at him plus the whole library, is what they are going for to distance the government from his politics.

Re: John Cobin in the news
With 10 months time served and covid19 positive I'd think he could get house arrest ankle monitoring as at least some component of his ultimate sentence. However deportation is likely going to happen, after any sentence is completed, if he does somehow actually truly still has us citizenship. Mixed reports on that status

Good insight, interesting stuff. Hopefully thats the case and judges are becoming a bit more balanced with their decisions, rather than bias towards criminals and their "human rights" , which they shouldn't have been in the first place, but guess that comes with the history of the country.

Re: John Cobin in the news
Another thing to keep in mind is that the sentencing and prosecution involving fire arm violations has always been much more strick and much more effort has been put in to it, even though the media makes it sound like they are never prosecuted.
A quick example, two guys were arrested for illegal hunting in the south. They got some fines for the illegal hunting part. One of them had done some minor modififcations to their gun, think it was a longer barrel to increase range, and received a 5 year sentence for those modifications alone.
If you watch the news recently, there has been a steady srteam of busts related to arms trafficking and possession. The government has since last year been highly prioritizing getting the flow of illegal guns off the street. Like everywhere, cops might be the keystone cops on every other front, but no cop wants to be surprised by a gun on the street.
For clarity, there are zero legal ways for a civilian in chile to be in possession of a loaded firearm on the street. Zero. The moment he loaded a round outside his home or a firearms range, even if he had the temporary permit to transport it to the range (that apparently he did not), he committed a felony and he was no longer in legal possession of a firearm. His b.s. excuse about being on his way to the range is completely null and void allibi.
There is just no way they want to send a signal that bringing guns in to the protests on the street is going to be tolerated.
