new SII boleta taxes: how do i opt out?

I recently received an email from SII about an update to the law on how they tax people who "emitir boletas." Starting this year 2012 they will start taking out a percentage of your payments to be reserved for your pension, work accidents, and healthcare.

From what I understand, in the past they took out 10% of your salary which after declaring taxes, and almost everyone received all of that 10% back. With the new loaw you will have to pay back taxes when you declare your 2013 tax return, but you may also pay monthly from now on. There is a transition period when not all of your boletas will be taxed, and you may also opt out of the transition, which will be fully implemented by 2015.

According to the email it is possible to opt out until 2015. I've poked around the SII website and the Prevision Social website provided and haven't found info on how to opt out. I'm hoping I won't have to call since my cel can't call toll free.

Anyone have further info?

El Servicio de Impuestos Internos (SII) le informa que, según la Ley 20.255 de 2008, sobre Reforma Previsional, a contar del año 2012 comenzarán a realizar cotizaciones para pensiones, accidentes del trabajo y enfermedades profesionales, las personas que:
Perciban honorarios por actividades independientes; o
Perciban rentas por Boletas de Honorarios; o
Perciban rentas por Boletas de Prestación de Servicios de Terceros; o
Perciban rentas por Participaciones en Rentas de Sociedad de Profesionales
A partir del 2015, cotizar para pensiones y accidentes del trabajo y enfermedades profesionales será obligatorio. Con anterioridad a esa fecha, durante los años 2012, 2013 y 2014 existirá la posibilidad de manifestar su voluntad de no cotizar.
La Renta Imponible Previsional corresponderá al 80% de la suma de las rentas brutas, anteriormente señaladas. Sin embargo, existe un periodo de transición, los años 2012, 2013 y 2014, en los cuales la renta Imponible Previsional será, respectivamente, el 40%, 70% y 100% de este monto.
Las cotizaciones para pensiones deben pagarse durante el proceso de la Operación Renta del año 2013. Sin embargo, el trabajador podrá enterarlas mensualmente, adelantándose al pago. Además, durante el año 2012, para tener la cobertura del seguro de invalidez y sobrevivencia, será necesario cotizar mensualmente para pensiones.
Las cotizaciones previsionales para accidentes del trabajo y enfermedades profesionales deben enterarse mensualmente. De esta forma si usted desea contar con cobertura para accidentes del trabajo y enfermedades profesionales a contar de enero del 2012, deberá pagar su primera cotización durante los primero 10 días de febrero del 2012.
Pagar cotizaciones previsionales permitirá a estos trabajadores independientes acceder a los mismos beneficios que los trabajadores dependientes, incluyendo asignaciones familiares; seguro por accidentes laborales y enfermedades profesionales; pensiones de vejez e invalidez; y, en caso de fallecimiento, pensiones de sobrevivencia para sus beneficiarios. Para acceder a los beneficios del sistema de salud, se deberá cotizar para ese régimen, lo que será obligatorio a partir del año 2018.

Sorry but you are getting confused. The 10% tax you suffer when you issue a boleta, is in effect, an advance payment of your income tax. You may or may not get some or all of that back at the end of the year, depending on your total income. If you don´t know how that part works, send me a PM and I´ll detail it for you. This is a retention tax. This has nothing to do with what SII is talking bout in their email. What they are on about is a new law that will require that not only employed people save in an AFP. Up to now, if you are self employed, you have no obligation to save for a pension. The government is concerned that too many self employed people will end up reaching retirement age with no pension fund available so they have intrtoduced this law which as the email says , is voluntary at present but will, in a couple of years become obligatory. So for now, don´t worry, nothing will change unless you decide to make it change. There is no proposal to change the retention tax.

Maybe my original post wasn't clear. I am not asking about the 10%, I know this stays as is, and it is the income tax. You declare it, and you get all, some, or none back depending on whatever factors the SII has defined.

I am asking about the imposiciones based on the NEW pension law. You say it won't happen for a few years, but the email states that it will begin this year in 2012, ramping up to complete implementation in 2015.

So my question is how do I manifest my intention not to buy into the pension system?

I'm sure admin or others have a better idea here, but surely you just don't sign up for a pension scheme?

Someone else started a thread about this a couple of weeks ago: topic7337.html

I know that, just like anything else in Chile, signing up for a Pension is not easy (and then actually paying into it, at least for me, was a pain in the a@#$. First actually having to go somewhere and queue, then trying to get information from ANYONE about how to make payments online). I can't see that this would be automatic and my reading of this as that as of 2015 it is mandatory to have signed up for and be paying into at the full rate, an AFP.

I have another question for anyone who has been doing this AFP independent worker thing for longer than I have: is "cotizaciones previsionales para accidentes del trabajo y enfermedades profesionales" included in the AFP payment, or is this something different that I need to sign up for?
