Thank you all for your un-dutch-like warm replies :)

I am left with on little glimmer of hope for this thread. For Dutch law people that are "sort of married" or "really married" are similar for the law. Indeed, it is I believe a legal point that they are not to be treated differently. (disclaimer: astronomers and legal knowledge are not always a good combination).

If this is the case, is the Chilean consulate in the Netherlands also obliged to treat them as equals?
I probably already know the answer, but my glass of rain is always half full.

The easy way is she enters on a tourist visa, then when she finds something to do she easily gets a visa “subject to contract”, or you guys spend a night every 3 month in Argentina for the 3 years you are in Chile. Or possibly lest viable, marry her you cad!!!!!!

And the answer to your “equal” question, no they are not under any obligation to treat you in Chile as you would be treated in Holland.

I have been happily living here on a tourist visa due to the fact I work outside of Chile, however I went into the government office to ask about visas (where I had a perfect english speaking friendly lady talk to me, what a nice surprise) and basically say not a problem to apply for tempeory residence, but for my plans to open a buisiness I need to fill in extra visa paper work which is not a problem, but for my best and easiest visa rights, is just to get married to my girlfriend (who has pernament residency here, but does not have chilean passport). Which yes hit a nerve when my girlfriend was sitting next to me grinning about the thoughts of an expensive white dress and big cathedral wedding, haha. :wink:

Good luck on your move! And welcome to the extended astronomy community of the North of Chile. My husband works at the Las Campanas site north of La Serena, where we live, and I know many of the women who work or whose husbands work at Cerro Tololo near Vicuna. What part of the desert will you be living in, if you don't mind my asking? There are so many telescopes up here!

thank you for your welcome! I will be working for the Uchile on Cerro Calan in Santiago, but hope to make it north often for observing and of course non-work-related travels. I especially hope to visit the ALMA site, but for me all telescopes are created equal :)

Clarrify the marriage issue. Chile does not have to recognize anything when it comes to family relationships. For example, if two gay guys were married in the Neatherlands, Chile is not going to recognize it simply because the Dutch do. Although there is law in the works to recongize civil unions (including some sort of legal status for gays), it still is not clear that will be extended to foreign civil unions. If it is, it will likly be a while before they fix that problem.

On the flip side, if you get married and then divorced, Chile does not automatically recognize the divorce either. So, breaking a legal marriage can be just as complicated. For example, a lot of countries recognize quick divorces. In Chile it has to be certified in front of judge to be even considered.

The bottom line is that what ever sort of "union" it is, must comply with Chilean law to be valid in Chile. They are not going to recognize a marriage to a three headed goat, a rock, or whatever either.

Does it make sense? Of course not. I believe you should have to right to marry a three headed goat if it makes you happy. It is what it is. Your goal is to get through immigration with the least amount of hassle. You are not going to convince a high school grad making 300,000 pesos a month the finer points of international law.

SO, we did get a registered partnership (also known as a gay marriage to my friends back home) in the Netherlands, but right now I don't think we'll even bother to tell the Chilean authorities. Right now I am here with with a temporary residency permit and my RP is here on a tourist visa. She is looking for work and I distilled from this forum and some phone calls to the dutch embassy that getting a job on a tourist visa is actually less of a hassle than doing so on a 'dependent' status.

This has left some ties loose back home (such as health insurance) that will likely coast us a couple of extra bucks, but those'll be hopefully tied up in the coming months.
