My wife had a 10 year tourist visa, but her uncle was also a diplomat at the UN and she worked for a prominent Chilean senator when it was granted. We never bothered to renew it simply because we have no reason to ever go to the States. Her last trip through the states, simply transferring airplanes in Miami, resulted in a 20 min interrogation. So neither of us have much of an interest in ever going there any time soon.
I'm concerned about something very similar. I'm a US citizen who's been here for a year. I recently married my Chilena here in Stgo. She has a 10 year US tourist visa from before we were married that won't expire for another 8 years. She has a good job here and I'm able to work from anywhere so we are planning to stay in Chile for at least a few years. We are expecting a baby in April 2012 (will be born here) and we'd like to spend a few months of her licencia in the USA next June thru Sept to see friends and fam.
Does anyone know if she could be denied entry when we go? I can only imagine how it's going to look when I show up in the US customs with my Chilean wife and child saying I'm just coming for a visit. Would it be better to go ahead now and apply for her US immigrant visa even though it will be revoked after we return to Chile next fall? I also understand that once she applies for the US immigrant visa she can't use her tourist visa...que debemos hacer?? Thanks
