Canadian needing advice on divorcing a chilean

I was married to a Chilean for over a year, and went to Chile to live with him and his family, I came back to Canada, for one reason that was to see my children, when i came after 6 months of being here, I felt that I should stay here to be with them, I should never have married this man...it was unfair to him and my children...anyways I have been back now for over 2 years now, and we have both decided that it would be best to go our own way, my question is first I never registered my marriage here in Canada, so as far as paperwork here is involved it looks like I am single or actually divorced from a previous marriage, he is trying to find out how he can file for divorce in Chile...where does he go......where does he start…we both want a simple ( and i know it’s not simple) divorce, there are no hard feelings between the 2 of us, we will always be friends, so there is no battle for what he has, what I have or alimony and stuff like that. Our marriage in Chile was a civil wedding if that helps any.

Get a lawyer it is the only way, he will have to go to court in Chile. You will have to sign off on everything and it will take time, the easy divorces tend to go to the bottom of the pile because there are no immediate issues. Been there done that.

yea, as a foreigner you are definitely going to need a lawyer that specializes in foreign divorces. it adds a whole mess of extra paperwork to the process.

since you have been separated so long, you might be able to get the separation accepted by the courts and save some time. official separation must be certified by the courts, you can not just claim you have been separated.
