The Advantages for a Chilean marrying an American

Hi,

I'm an American citizen and I've been asked by a Chilean to marry him. I have no intention of moving back to The States.
My question is this, why would a Chilean wish to marry an American? What possible legal advantages would it give him.

Yes, I have money in The States but my understanding is that when you marry in Chile, you can check a box which states that you wish to keep all your assets separate from your spouse's assets. If this is true, and I'm not moving back to The States, are they any other LEGAL advantages for him, as a Chilean citizen to wish marriage to an American? Thanks

He's a poor Chilean guy. He doesn't have money (not even hidden money). Also, in The States, when you divorce, assests that are not jointly owned, are not divisible during a divorce. Are there any other LEGAL advantages for a Chilean to marry an American? Thanks

It takes 2 to tango and obviously you don't want to dance otherwise you wouldn't be asking suspicious questions so why worrying about it. There are NO legal advantages for him other than those already explained earlier.The US is becoming another third world country anyway so probably you'll be asking him in a near future the same since you'll be better off here than in the so called "the greatest country in the world"....it's just a matter of time. Remember Reagan's slogan..."just say no" :D

Yea, that box does not quite work the way you think it does. He still has all kinds of rights to your marital property, at least in Chile. Spouses generally also have the right to ask for alimony. Even many Chileans seem to not generally understand what it means, and does not mean, especially now that there really are divorce laws to make "separation of assets" mean something in practice.

If you have to ask, then something is wrong... Usually a person that has been burned in the past, finds it difficult to trust... but without trust, love is a treacherous, if not impassable road to travel... IMHO.

We are an older couple, meaning, we won't be having kids together.
Is it possible that he could legally ask me for alimony if things didn't work out?
What if we don't have any joint assets, meaning, we rent and don't own a vehicle, etc???

I can't think of any reason to not learn what marriage involves before getting married. Closing your eyes and jumping might be romantic, but it sure leads to a lot of unnecessary pain later.

I also recommend doing some minimal background checking and running a credit report on a prospective spouse. Again, not so romantic, but it would prevent a great deal of heartbreak. I can't see any benefit to marrying someone you actually know very little about and just crossing your fingers and hoping.

News flash, ladies: men lie. And visa versa, guys. Is there really any good reason to not take a few minutes to understand what you are getting into?

I'm certain he has no criminal background. The only debt he has is the monthly payment to his ex-wife for his 2 children to attend private school. This is part of his divorce agreement with Chilean ex-wife. Is there any chance that I could be forced to help him make that payment if things don't work out between us and he can't make the payments? Thanks
