circumventing judicial process

Postby Andres » Sat Aug 11, 2012 7:10 pm

10 USC § 332 - Use of militia and armed forces to enforce Federal authority

Whenever the President considers that unlawful obstructions, combinations, or assemblages, or rebellion against the authority of the United States, make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings, he may call into Federal service such of the militia of any State, and use such of the armed forces, as he considers necessary to enforce those laws or to suppress the rebellion.

One interpretation: If any citizen or any state takes action which the President does not like, and the court system refuses to do his bidding (what he says), he can use the military or the state's militia to enforce his wishes, even if the courts disagree.

10 USC § 333 - Interference with State and Federal law

The President, by using the militia or the armed forces, or both, or by any other means, shall take such measures as he considers necessary to suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy, if it—
(1) so hinders the execution of the laws of that State, and of the United States within the State, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or
(2) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.
In any situation covered by clause (1), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.

One interpretation: We don't care what state governments think, even in respect to their own laws.

10 USC § 334 - Proclamation to disperse

Whenever the President considers it necessary to use the militia or the armed forces under this chapter, he shall, by proclamation, immediately order the insurgents to disperse and retire peaceably to their abodes within a limited time.

One interpretation: If the President does not like what you say or do, you no longer have the right of assembly.

A movie is in the works, Gray State, with a plot that follows a similar scenario:

Rule of Law now = Law of Rule.

BTW Paul Ryan, Romney's pick for VP, voted Yea for every extension of surveillance authorities under the Patriot Act, the NDAA, and the creation of the "Constitution-free" zone extending 100 miles inside every national border.

I think posts about those Minions are on four or five threads right now. In Chile, some believe they are part of the CIA and we know they are Bohemian Grovers. And recently, they just opened a $1.3 billion shopping mall in Salt Lake City with all the best names in fashion........even some of the faithful are questioning..........

I'm sure they are excellent pay on time renters but I did notice they left 2 mattresses and other shit out on the balcony for about a month before the new young missionaries arrived. Then there were three days of annoying maestro concrete drilling to prepare for the newbie missies. On a brisk but sunny day sometime last week with my balcony and other windows open to air out the departamento, I peered down from my balcony into one of the rooms below which looks like an office and they had a huge electric heater on full orange-red heating coil max going. Yep, newbies to Chile from the States. :)

FDA spy pgm on its scientists, lawmakers, reporters, academi

Postby Andres » Mon Aug 13, 2012 8:02 pm

Maybe this is old news; my apologies if it is.

http://truth-out.org/news/item/10524-fo ... -of-safety

The first bit:

The Food and Drug Administration (FDA) is often accused of serving industry at the expense of consumers. But even FDA defenders are shocked by reports this week of an institutionalized FDA spying program on its own scientists, lawmakers, reporters and academics that included an enemies list of "actors" and collaborators.

The paranoid and retaliatory email monitoring program, which sought to suppress the safety opinions of those hired to give their safety opinions, has provoked swift action from Capitol Hill.

. . .

FDA managers "committed the most outrageous misconduct by ordering, coercing and intimidating FDA physicians and scientists to recommend approval, and then retaliating when the physicians and scientists refused to go along." Review procedures at the agency (which approves stents, breast implants, MRIs, and other devices and machinery) were so faulty that unsafe devices - including those that emit excessive radiation - were approved, charged the scientists, provoking an OSC investigation.

For reporting the safety risks, the scientists became targets of the now-disclosed spy program and some lost their jobs. "It has been brought to our attention that FDA management may have just recently ordered the FDA Office of Criminal Investigations (OCI) to investigate us, rather than the managers who have engaged in wrongdoing!" wrote the FDA scientists
"Blessed are they who have nothing to say and can not be persuaded to say it."
"Laziness is the mother of invention."
