U.S. Chile Income tax treaty

Postby admin » Sat Jan 30, 2010 9:37 pm

The U.S. and Chile are announcing that they have concluded negotiations of a income tax treaty. One problem, I can not seem to find a copy of it. Anyone know where there is an online copy in English?

All I can find is this rather vague press release:

January 26, 2010

U.S. and Chile Announce Conclusion of Tax Treaty Negotiations

Consistent with its efforts to expand the U.S. tax treaty network in South America, the U.S. Department of the Treasury announced today the conclusion of the negotiation of a comprehensive bilateral income tax treaty with Chile.

The new tax treaty would provide certainty and stability of tax treatment for U.S. and Chilean cross-border investors. The new tax treaty also provides for reductions in source-country taxation of cross-border payments of dividends, interest, and royalties; the full exchange of information between the tax authorities of the United States and Chile; and a comprehensive limitation on benefits provision aimed at preventing the abuse of the tax treaty by third-country investors.

The new tax treaty with Chile is scheduled to be signed by both countries in February. If approved by the U.S. Senate, the treaty with Chile would be only the second U.S. tax treaty with a South American country.

I have sneaking suspicion this one is being rammed through at the 11th hour, as they don't think the next administration will bite. Cross our fingers and hope it does not burn both the Expats in Chile and Chileans.

We did contact the Chilean foreign affairs ministry, and they told us that it was being negotiated by the Chilean and U.S. tax authorities directly and they had nothing to do with it.

It hasn't been ratified by the US Senate yet (constitutional requirement, you know). I suspect it will be released to the public at that time.

Information, we want information... 8)

There are many other countries with tax treaties, but as they say, the devil is in the details.
